Amicus Curiae: Ghost Golf, Inc., et al., v. Governor Gavin Newsom, et al

Dhillon Law Group has filed an amicus curiae brief supporting Ghost Golf, Inc., and other small businesses in their petition to the California Supreme Court for review of a case against Governor Gavin Newsom. This case challenges the broad emergency powers granted to the Governor during the COVID-19 pandemic. Ghost Golf and other affected businesses argue that these powers were used to impose unfair and arbitrary restrictions, leading to significant economic harm and violations of civil liberties. The brief emphasizes that the Legislature’s delegation of such extensive powers to the Governor lacks proper checks and balances, violating the constitutional principle of separation of powers.

The California Supreme Court must clarify the limits of executive authority during emergencies to prevent future overreach. The current legal framework has allowed the Governor to make sweeping decisions without adequate legislative oversight or clear standards, impacting the livelihoods of small business owners and restricting individual freedoms. This case is crucial in ensuring that emergency powers are exercised within constitutional boundaries, protecting both economic interests and civil liberties in California.
