Ryan represents pioneering clients in tricky intellectual property (“IP”) dealings. These include apportioning IP ownership rights among co-founders, make or break litigation involving alleged circumvention (a/k/a “hacking”), and prosecuting digital privacy violations. In conjunction, Ryan is a non-residential fellow of Stanford Law School’s Center for Internet and Society, Vice Chairman of the Licensing & Technology Transactions Group, California Lawyers Association, and a member of the First Amendment Lawyers Association.

Since 2006, Ryan’s “insightful and pragmatic” counsel has helped clients navigate intricate legal waters. For example, he advised iTunes app Kanvas Labs concerning its copyright strategy to facilitate an acquisition by AOL; successfully resolved multimillion dollar circumvention allegations for Taiwan based tech hardware company LegendSky; and negotiated a complex sales agreement for SaaS company Alluring Logic (acquired by Proximity Insight). Along the way, he has written for TechCrunch, among others, about tech/media issues such as how companies should tackle AI “deep fake” posts.

  • Defended the deposition of an ex-Google privacy researcher in two class actions, one which alleged civil and criminal digital privacy related claims totaling $5 billion in damages in the Northern District of California. Calhoun v. Google, LLC, 526 F. Supp. 3d 605 (N.D. Cal. 2021) and Brown v. Google, LLC, 525 F. Supp. 3d 1049 (N.D. Cal. 2021);
  • Favorably settled 74 copyright claims, totaling $2.2 million in maximum statutory damages, on behalf of media clients to vindicate their First Amendment rights in the Southern District of New York. Watch Tower Bible and Tract Society of Pennsylvania v. The Truth and Transparency Foundation, et. al., No. 1:20-CV-03366;
  • After filing antitrust counterclaims, negotiated a confidential settlement and license agreement defending a foreign hardware company against Intel and Warner Brothers in a DMCA circumvention case filed in the Southern District of New York. Warner Brothers et. al. v. LegendSky Tech Co., Index No. 15-CV-10169;
  • Provided counsel to Kanvas, a best new iTunes app which was acquired by AOL, on copyright fair use issues concerning the syncing of music under the Apple iTunes license;
  • Counseled Open Influence (f/k/a “InstaBrand”), a digital ad start-up that promotes brands on Instagram, on the existence or scope of fiduciary duties per client/promoter agreements;
  • Advised Gelo Factory, a software development firm, on the scope of warranties in client agreements with Toyota, among others, and the preparation of the company’s operating agreement;
  • Strategic advising to Alluring Logic, an SaaS company that serviced the retail sector, concerning the protection of its source code so as to enable its acquisition by Proximity Insight; and
  • Outside general counsel to Situation Interactive, a digital ad concern, in connection with Child Online Privacy Protection compliance for its marketing materials and fair use of third party-content.
